Apple seeks $1 billion from Samsung at retrial for patent violations

Apple vs Samsung22

"Do you remember what cell phones looked like in 2006?" Samsung provides key components to Apple's flagship laptops, smartphones and table computers.

"Lawsuits can take a long time", Lee told jurors Tuesday.

Before 2016, the Supreme Court hadn't considered design patents since disputes involving spoon handles in the 1870s and carpets in the 1890s.

Apple also included 2 utility patents covering its bounce-back scrolling and pinch-to-zoom features.

Samsung is asking the jury to determine how much each of these discrete elements is worth and then assess damages accordingly.

Apple and Samsung are now fighting it out again.

The case not only will determine how much Samsung has to pay but how much countless other technology companies in the future might also have to worry about patents.

The trial first erupted in 2011, just a year after Apple released the original iPhone 4. It shouldn't have to pay for the other parts since Apple's patents don't cover the whole phone. It argues that customers were not only buying its handsets because of the design, but also due to their "functionality".

They are called "enlisted plans" in Europe and most parts of the world, however "outline patents" in the US.

"What was Samsung's solution?" he asked the jury rhetorically.

Apple is claiming $1 billion awards from Samsung during the damages retrial this week.

Samsung argues that Apple infringed upon patented features used in its tablets and phones. The scope of Apple's design patents "are so very narrow" he said.

The latest trial kicked off in San Jose, Calif., after a judge past year found the jury instructions in the original 2012 trial misstated the law and ordered a new trial. Samsung's lawyers appealed the case, bringing down the compensation of $1 billion to $400 million in 2015 at the US Court of Appeals for the Federal Circuit.

The Supreme Court agreed. Apple was initially granted $1.05bn (£772m) in 2012 after a jury found the South Korean firm had encroached a few of the iPhone's developments.

Motorola appears to be working on a foldable smartphone that turns into a tablet, along with the likes of the Samsung Galaxy X, Apple foldable iPhone and Huawei foldable phone.

Apple has described how the iPhone and overall product design became embedded in the company's DNA. But she's blocked Apple's argument that the phones should be viewed from the perspective of a "designer of ordinary skill in the art", saying there's no basis for importing the "person of ordinary skill in the art" to the design context.
